HMA v Ross Alan Pullinger

At the High Court in Edinburgh today, 26 September 2019, Lord Uist sentenced Ross Pullinger to seven years and nine months’ imprisonment after the accused was found guilty of the rape of a nine-year-old girl and other sexual offences.

On sentencing, Lord Uist made the following statement in court:

“You were convicted by the jury of four sexual offences, namely, charges 2, 4, 7 and 9 on the indictment. You also pleaded guilty to charge 11, a charge of failing to appear at a preliminary hearing at Glasgow High Court on 10 December 2018.

“Charge 2 involved the crime of assault with intent to rape an adult woman between 1 January 2007 and 31 August 2008.

“Charge 4 involved sexual abuse of a nine-year-old girl between 3 December 2002 and 2 December 2003 by touching her private parts and making her touch yours.

“Charge 7 involved the rape of the same girl in a park between 3 December 2008 and 2 December 2009 when she was 15 years old.

“Charge 9 involved abuse of another girl on various occasions between 6 February 2003 and 5 February 2008 when she was aged between four and nine by touching her private parts.

“Your crimes have had serious effects on your victims.

“You are now 42 years old. You have a good work record.

“Your criminal record discloses four previous court appearances. Your only relevant conviction for present purposes was in 2007, when you were fined £200 for domestic assault.

“I have read the very full criminal justice social work report on you and considered all that has been said on your behalf in mitigation, but you must appreciate that you were convicted of grave sexual offences and these must attract a significant custodial sentence.

“On charges 2, 4, 7 and 9 taken together the sentence which I impose is seven years’ imprisonment from 28 January 2019.

“On charge 11 the sentence is nine months imprisonment, reduced from 12 months imprisonment for your plea of guilty, to be consecutive to the sentence on the other charges.

“Your total sentence is therefore seven years nine months imprisonment from 28 January 2019.

“As a result of the sentence on the sexual offences you now become subject to the notification requirements of the Sexual Offences Act 2003 for an indefinite period.”
