HMA v Slavi Todorov

At the High Court in Edinburgh today, 6 August, 2018, Lord Ericht sentenced Slavi Todorov to 7 years imprisonment for causing death by dangerous driving.

On sentencing, Lord Ericht made the following statement in court:

“You have been convicted of death by dangerous driving under section 1 of the Road Traffic Act 1988 and you also pled guilty to drink driving.

I turn first to charge 1, which is the section 1 offence. You drove on the wrong side of the road and collided head on with the car being driven by Mr Mackie. I have taken into account the contents of the Criminal Justice Social Work Report and all that has been said on your behalf. I have taken into account the concern you expressed for Mr Mackie immediately after the accident, and your remorse. You have no previous convictions and a good driving record. I note that you had recently returned from Bulgaria, where cars drive on the opposite side of the road from the UK, and that you had exited from a single track road on to the wrong side of a quiet main road. All of that is in your favour. However, what is not at all in your favour is that you were around three times over the drink driving limit. Consumption of substantial amounts of alcohol had grossly impaired your driving. Your drinking deprived Mr Mackie’s wife of a devoted husband she had known for almost fifty seven years and their family of a much loved father.

I sentence you to a period of imprisonment of 7 years, backdated to 4 July 2018. I order endorsement of your driving record. I disqualify you from holding or obtaining a driving licence for a period of 10 years from this date and order that you sit the extended test of competence.

I now turn to charge 2. You drove with 64 microgrammes of alcohol in 100 millilitres of breath. The limit is 22 microgrammes. You pled guilty at the Preliminary Hearing and again at the start of the trial but your plea was not accepted until the end of the Crown case. Had you not pled guilty at an early stage I would have sentenced you to 3 months in prison and disqualified you from driving for one year. However in light of your early plea, I sentence you to a period of imprisonment of 9 weeks backdated to 4 July 2018 and concurrent with the sentence on charge 1. I order endorsement of your driving record. I disqualify you from holding or obtaining a driving licence for a period of 9 months  from this date, concurrent with the disqualification imposed under charge 1.
