HMA v Duncan Burns

At the High Court in Glasgow today (12 December 2017) Lord Mulholland sentenced Duncan Burns to five years imprisonment after the accused was found guilty of rape. On sentencing Lord Mulholland made the following statement in court:

“Duncan Burns, you were convicted by a jury of rape.

"The jury rejected your evidence that the sexual intercourse with the complainer was consensual and believed her account of rape. The jury held that you had sexual intercourse with the complainer without her consent. Despite making it plain to you that she did not want to have sexual intercourse with you, you ignored her wishes and used force to have sexual intercourse with her.

"That amounts to the crime of rape in Scotland. This court takes a very serious view of such criminal conduct. You will be sentenced to five years imprisonment, backdated to 1 November 2017.”
