HMA v Angela Ryan and Jason Kirby

At the High Court in Edinburgh today, 6 December 2016, Lady Scott sentenced Angela Ryan to four years imprisonment and Jason Kirby to five years imprisonment, after both accused pled guilty to assault and robbery.

On sentencing, Lady Scott made the following statement in court:

“You have both pled guilty to the violent and heartless robbery of a very vulnerable and significantly disabled man.

You knew his vulnerability well, as you Angela Ryan had befriended and exploited him previously and you knew he kept his savings in his house.

This robbery was planned: you went late at night, with faces masked and a rope. You pushed your way into the house, tied the rope around his neck as a ligature, pulled it tight and with considerable force, so that he had difficulty breathing and he was rendered unconscious.

This assault was to the real danger of your victim’s life and he thought he was going to die. He was left with severe injuries consistent with strangulation.

I take into account that you have both pled guilty at an early stage and have expressed remorse.

Ms Ryan you have a record of summary convictions which reflect your drug addiction.

Mr Kirkby you have a more serious criminal record which includes two convictions for assault and robbery from the High Court, albeit they are of some age.

Angela Ryan I sentence you to four years imprisonment reduced from six years to reflect your early plea, which sentence is backdated to 24 August 2016.

Mr Kirby I sentence you to five years imprisonment reduced from seven years to reflect your early plea, which sentence is backdated to 24 August 2016.”
