HMA v Robert Sinclair Richards

At the High Court in Edinburgh on 24 February 2016, Lord Uist sentenced Robert Sinclair Richards to six years imprisonment after the accused pleaded guilty to having been concerned in the supplying of heroin and cocaine.

On sentencing, Lord Uist made the following statement in court:

“Robert Sinclair Richards, you have pleaded guilty to having been concerned in the supplying of heroin and cocaine in Aberdeen between 16 and 26 November last year.

When the police raided the flat which you occupied at 492c Holborn Street on 26 November they found a total of nine packages of heroin with a maximum street value £630 and 16 packages of crack cocaine with a maximum street value of £1,300. You were also found to be in possession of £350 in cash.

It is clear from these discoveries and from what you said to the police that you were engaged in commercial dealing in these two dangerous drugs over the period in question. You must have known the risk you were running and the possible consequences for you if caught. You must now face the consequences.

You are now 44 years of age. You have the distinction of having three previous convictions for being concerned in the supplying of class A drugs.

In 2006 you were sentenced to two years imprisonment, in 2007 you were sentenced to three years imprisonment and in 2009 you were sentenced to five years 219 days imprisonment, the minimum sentence after discount for a third drug trafficking conviction involving a class A drug.

This is now your fourth conviction for being concerned in the supplying of a class A drug. The minimum sentence to which you are subject is seven years imprisonment before any discount for a plea of guilty.

Had you been convicted by a jury after trial I would have imposed a sentence of nine years imprisonment on each charge, those sentences to run concurrently. As you pleaded guilty at an early stage those sentences will be discounted to six years imprisonment on each charge and will run concurrently from 27 November 2015.”
